These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and MoSciFIT ("MoSciFIT," "we," "us," or "our") governing your access to and use of the MoSciFIT website, mobile applications, software, services, content, features, and related offerings (collectively, the "Service").
PLEASE READ THESE TERMS CAREFULLY BEFORE USING MOSCIFIT.
BY CREATING AN ACCOUNT, ACCESSING, PURCHASING, SUBSCRIBING TO, OR OTHERWISE USING MOSCIFIT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY, AS AMENDED FROM TIME TO TIME.
IF YOU DO NOT AGREE TO THESE TERMS, DO NOT ACCESS OR USE MOSCIFIT.
These Terms contain important provisions concerning assumption of risk, releases, disclaimers, limitations of liability, dispute resolution, arbitration, and waiver of class and representative proceedings.
MoSciFIT is a fitness, nutrition, wellness, educational, and technology platform. Depending on the features available to you, MoSciFIT may provide or facilitate access to: workout programs and exercise recommendations; fitness tracking and workout logging; nutrition information, meal suggestions, and nutrition planning; general wellness information; supplement related information or suggestions; exercise form and movement analysis; artificial intelligence generated recommendations and content; personalized fitness or wellness recommendations based on information you provide; cycle related or other wellness insights; progress tracking; community and social features; photographs, videos, text, educational materials, and other user generated content; and other features that we may introduce, modify, suspend, or discontinue. MoSciFIT may change, add, remove, restrict, suspend, or discontinue any feature or portion of the Service at any time. We do not guarantee that any particular feature will remain available.
MOSCIFIT IS NOT A PHYSICIAN, MEDICAL CLINIC, PHYSICAL THERAPIST, REGISTERED DIETITIAN, NURSE, PSYCHOLOGIST, PSYCHIATRIST, OR OTHER LICENSED HEALTHCARE PROVIDER.
MoSciFIT does not provide medical care. Information provided through the Service is intended solely for general educational and informational purposes and is not intended to constitute: medical advice; diagnosis; treatment; physical therapy; individualized medical care; professional nutritional counseling; psychological or psychiatric care; emergency medical services; or a substitute for any sort of professional healthcare. No healthcare provider relationship is created between you and MoSciFIT through your use of the Service. You should consult an appropriately qualified and licensed healthcare professional before beginning or changing any exercise, fitness, nutrition, supplement, weight management, wellness, or other health related program. This is particularly important if you have or may have a medical condition, injury, disability, symptoms, physical limitation, eating disorder, pregnancy related concern, cardiovascular condition, or any other health concern, or if you take prescription or non prescription medications or supplements. Never disregard professional medical advice or delay seeking professional medical care because of information provided through MoSciFIT.
Certain MoSciFIT features use artificial intelligence, machine learning, automated systems, algorithms, computer vision, pose detection, or other automated technologies ("AI Features"). AI generated or AI assisted content may include workout recommendations, nutrition information, meal suggestions, supplement related information, form analysis feedback, wellness insights, explanations, summaries, or other recommendations. You acknowledge and agree that: AI generated content may be inaccurate, incomplete, outdated, misleading, inappropriate, or unsuitable for your individual circumstances. AI systems may produce incorrect or unexpected information. AI generated recommendations are not guaranteed to be safe, accurate, complete, or appropriate. AI systems do not replace qualified human professionals. MoSciFIT does not guarantee that AI generated content will identify injuries, medical conditions, unsafe movements, contraindications, nutritional deficiencies, medication interactions, or other health risks. You must independently evaluate information provided through the Service and consult an appropriately qualified professional when appropriate. You assume responsibility for deciding whether and how to act on information provided through the Service. You agree not to rely exclusively on AI generated content for decisions involving your health, safety, medical treatment, medication, supplements, nutrition, exercise limitations, or other potentially consequential matters.
PHYSICAL EXERCISE AND FITNESS ACTIVITIES INVOLVE INHERENT RISKS.
These risks may include, without limitation: muscle soreness; strains; sprains; bruising; falls; fractures; joint injuries; ligament or tendon injuries; back or neck injuries; aggravation of pre-existing conditions; dizziness or fainting; dehydration; heat related illness; cardiovascular events; respiratory complications; disability; and, in rare circumstances, death. You voluntarily choose whether to participate in any exercise or physical activity suggested, displayed, demonstrated, or otherwise made available through MoSciFIT. You are solely responsible for determining whether an exercise or activity is appropriate for you.
YOU ASSUME ALL RISKS ASSOCIATED WITH YOUR VOLUNTARY PARTICIPATION IN EXERCISE, FITNESS, NUTRITION, AND WELLNESS ACTIVITIES TO THE MAXIMUM EXTENT PERMITTED BY LAW.
You agree to stop exercising and seek appropriate medical attention if you experience pain, chest pain, unusual shortness of breath, dizziness, fainting, weakness, numbness, severe discomfort, or any other concerning symptom. MoSciFIT is not responsible for determining whether you are physically capable of performing any exercise.
MoSciFIT may provide automated exercise form analysis using video, images, computer vision, pose estimation, artificial intelligence, or other automated technologies. These features are intended to provide general educational feedback only. Form analysis results may be affected by: camera position; camera angle; lighting; clothing; body position; movement speed; image or video quality; frame rate; device hardware; internet connection; occlusion; background objects; body proportions; exercise variations; and limitations or errors in the underlying technology. MoSciFIT does not guarantee that form analysis feedback is accurate or that it will identify unsafe movement, improper technique, injury risk, or a medical condition. Automated form analysis is not a substitute for in person instruction from a qualified fitness professional, athletic trainer, physical therapist, physician, or other appropriately qualified professional.
Nutrition information provided through MoSciFIT is general educational information and is not individualized medical or dietary treatment. MoSciFIT does not guarantee that any meal suggestion, food recommendation, calorie estimate, nutrient estimate, dietary recommendation, or supplement related information is appropriate for you. Food and supplement information may be affected by factors including: allergies; intolerances; medical conditions; medications; pregnancy; nutritional deficiencies; dietary restrictions; individual nutritional requirements; ingredient substitutions; product formulation changes; serving size differences; and inaccurate or incomplete information provided by you or third parties. You are responsible for reviewing product labels, ingredient lists, warnings, serving sizes, and other applicable information before consuming any food or supplement. Do not begin, discontinue, or modify medications or supplements based solely on information provided by MoSciFIT. Consult an appropriately licensed healthcare professional or registered dietitian for individualized nutritional advice.
MoSciFIT does not guarantee any particular result. Results from exercise, nutrition, wellness, or other programs vary from person to person. MoSciFIT makes no guarantee regarding: weight loss; weight gain; muscle gain; strength; endurance; body composition; athletic performance; appearance; nutrition outcomes; health outcomes; injury prevention; injury recovery; disease prevention; or any other physical or wellness outcome. Testimonials, examples, demonstrations, or statements regarding results are not guarantees of your individual results.
MOSCIFIT IS NOT AN EMERGENCY SERVICE.
Do not use MoSciFIT to address a medical emergency. If you believe you are experiencing a medical emergency, contact emergency services or seek immediate medical attention. MoSciFIT is not responsible for delays in receiving emergency or professional medical care.
MoSciFIT requires all users to be at least 13 years old. Our account creation process includes an age gate that blocks account creation for anyone who indicates they are under 13; MoSciFIT does not knowingly permit account creation by anyone younger. Users aged 13 to 17 may create an account, but must obtain verified parent or guardian consent, obtained through MoSciFIT's built in guardian consent process, before they can complete their fitness profile or use any training, nutrition, cycle, or health guidance feature. For users under 13, MoSciFIT will comply with applicable requirements relating to children's privacy and parental consent to the extent any such information is inadvertently collected. Parents and legal guardians are responsible for supervising minors' use of MoSciFIT and determining whether the Service is appropriate for them. A parent or guardian may contact MoSciFIT at moscifit.inquiry@gmail.com to request information concerning a minor's account, request deletion where applicable, or revoke consent where legally permitted. MoSciFIT may require reasonable verification of parental or guardian identity before taking action concerning a minor's account. We may suspend or terminate an account if we reasonably believe that required parental consent has not been obtained, has been withdrawn, or cannot be verified.
You are responsible for: maintaining the confidentiality of your login credentials; maintaining accurate account information; keeping your password secure; restricting access to your account; and all activity occurring through your account, except to the extent caused by MoSciFIT's own unauthorized actions. You agree to provide accurate and reasonably complete information when requested. This may include information relating to age, fitness level, physical limitations, exercise history, medications, supplements, dietary preferences, allergies, injuries, or other information used by the Service. The accuracy of information you provide may materially affect the content generated by the Service. MoSciFIT is not responsible for recommendations or outputs that are affected by information that is inaccurate, incomplete, outdated, misleading, or omitted by you. You must promptly notify MoSciFIT if you believe your account has been compromised.
You are responsible for your decisions and actions taken in connection with the Service. You agree to use reasonable judgment when applying any information provided through MoSciFIT. You acknowledge that MoSciFIT cannot know every aspect of your health, physical condition, environment, equipment, supervision, medical history, medications, nutritional status, or other circumstances that could affect your safety. Accordingly, you agree that you will not treat MoSciFIT's recommendations as individualized professional supervision.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU KNOWINGLY AND VOLUNTARILY ASSUME THE RISKS ASSOCIATED WITH YOUR USE OF MOSCIFIT AND PARTICIPATION IN ACTIVITIES SUGGESTED OR MADE AVAILABLE THROUGH THE SERVICE. YOU ACKNOWLEDGE THAT YOU HAVE BEEN ADVISED THAT PHYSICAL ACTIVITY, EXERCISE, NUTRITION CHANGES, AND OTHER WELLNESS ACTIVITIES MAY INVOLVE RISKS OF INJURY, ILLNESS, PROPERTY DAMAGE, OR OTHER LOSS. YOU VOLUNTARILY ACCEPT THOSE RISKS, INCLUDING RISKS THAT MAY RESULT FROM YOUR OWN ACTIONS, INACTION, JUDGMENT, OR MISJUDGMENT.
Nothing in this section releases liability that cannot lawfully be released under applicable law.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE TO RELEASE AND HOLD HARMLESS MOSCIFIT AND ITS OWNERS, OPERATORS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, SERVICE PROVIDERS, LICENSORS, PARTNERS, AND AGENTS FROM CLAIMS, DEMANDS, DAMAGES, LOSSES, LIABILITIES, COSTS, AND EXPENSES ARISING OUT OF OR RELATED TO: your use of the Service; your inability to use the Service; your participation in exercise or fitness activities; your use of workout recommendations; your use of nutrition or supplement related information; your reliance on AI generated content; your use of automated form analysis; interactions with other users; content submitted by other users; your decisions or actions based on information provided through the Service; or injuries, losses, or damages arising from activities you voluntarily undertake.
This release applies only to the maximum extent permitted by applicable law and does not apply to liability that cannot legally be waived or released.
THE SERVICE IS PROVIDED ON AN "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW. MOSCIFIT DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, WITHOUT LIMITATION: MERCHANTABILITY; FITNESS FOR A PARTICULAR PURPOSE; NON-INFRINGEMENT; ACCURACY; RELIABILITY; AVAILABILITY; SECURITY; COMPLETENESS; TIMELINESS; AND THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED. MOSCIFIT DOES NOT WARRANT THAT: AI-GENERATED INFORMATION WILL BE ACCURATE; EXERCISE OR NUTRITION RECOMMENDATIONS WILL BE APPROPRIATE FOR YOU; FORM ANALYSIS WILL BE ACCURATE; THE SERVICE WILL DETECT ALL SAFETY RISKS; THE SERVICE WILL PREVENT INJURY; THE SERVICE WILL PRODUCE ANY PARTICULAR RESULT; THE SERVICE WILL ALWAYS BE AVAILABLE; THE SERVICE WILL BE FREE OF BUGS, VIRUSES, OR OTHER HARMFUL COMPONENTS; OR INFORMATION PROVIDED THROUGH THE SERVICE WILL ALWAYS BE CURRENT OR COMPLETE.
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOSCIFIT AND ITS OWNERS, OPERATORS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES RELATING TO: PERSONAL INJURY; ILLNESS; HEALTH OUTCOMES; LOSS OF DATA; LOSS OF PROFITS; LOSS OF REVENUE; LOSS OF BUSINESS OPPORTUNITY; LOSS OF GOODWILL; LOSS OF CONTENT; BUSINESS INTERRUPTION; OR OTHER ECONOMIC OR NON-ECONOMIC LOSS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOSCIFIT'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO MOSCIFIT FOR THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
This limitation applies regardless of the legal theory asserted, including contract, tort, negligence, strict liability, warranty, statute, or otherwise, to the maximum extent permitted by law. Nothing in these Terms limits liability that cannot legally be limited or excluded.
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless MoSciFIT and its owners, operators, officers, directors, employees, contractors, affiliates, agents, licensors, and service providers from and against claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys' fees arising from or relating to: your use or misuse of the Service; your violation of these Terms; your violation of applicable law; content you submit, upload, transmit, or make available; your violation of another person's rights; your unauthorized use of another person's account; your participation in exercise, fitness, nutrition, or wellness activities; your reliance on or use of information generated by the Service; or your negligent, reckless, fraudulent, or intentional conduct. This indemnification obligation does not apply to the extent a claim is caused by MoSciFIT's own conduct for which indemnification is prohibited by applicable law.
You retain ownership of content you submit to MoSciFIT ("User Content"), including photographs, videos, workout logs, nutrition logs, comments, messages, and other materials. By submitting User Content, you grant MoSciFIT a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, reproduce, process, modify as technically necessary, transmit, display, and use that User Content solely as reasonably necessary to: operate the Service; provide requested features; analyze and process User Content to provide features to you; maintain and improve the Service; enforce these Terms; protect users and the Service; and comply with applicable law. Any additional use of User Content will be subject to the applicable privacy disclosures, settings, or consent mechanisms presented to you. You represent that you have the necessary rights and permissions to submit User Content. You agree not to upload content that you do not have the legal right to provide.
If you upload photographs or videos for exercise or movement analysis, you acknowledge that those materials may contain identifiable information about you or other individuals. You represent that you have permission to upload any other person's image or video. You are responsible for obtaining any necessary consent before uploading another person's likeness, image, voice, or other identifying information. MoSciFIT may process uploaded photographs and videos using automated systems, AI, computer vision, and third party infrastructure necessary to provide the requested Service, subject to the Privacy Policy and applicable law.
MoSciFIT may offer community, social, messaging, friend, sharing, commenting, or other interactive features. You are solely responsible for your interactions with other users. MoSciFIT does not guarantee the identity, qualifications, accuracy, reliability, safety, conduct, or intentions of any user. You agree not to rely on another user's statements as professional medical, fitness, nutritional, legal, financial, or other professional advice. MoSciFIT is not responsible for disputes, injuries, losses, harassment, fraud, misrepresentation, or other conduct occurring between users except to the extent required by applicable law. We may remove content, restrict features, or suspend accounts when we reasonably believe such action is necessary to protect users, the Service, or our legal rights.
You agree not to: violate applicable law; impersonate another person; provide false information; use another person's account without authorization; attempt to access another user's information; harass, threaten, stalk, abuse, or intimidate another user; upload malicious software; upload unlawful, fraudulent, defamatory, or infringing material; violate another person's privacy or intellectual property rights; reverse engineer the Service except where legally permitted; attempt to discover source code or underlying algorithms; bypass authentication or access controls; circumvent subscription or payment mechanisms; scrape or harvest information without authorization; use bots or automated systems to access the Service without permission; interfere with the operation or security of the Service; introduce malicious code; test or probe the Service for vulnerabilities without authorization; use the Service to develop a competing service in violation of applicable law; resell or commercially exploit the Service without permission; or use the Service in a manner that could reasonably endanger another person.
The Service and its contents, excluding User Content, are owned by or licensed to MoSciFIT and may be protected by copyright, trademark, patent, trade secret, and other intellectual property laws. Except as expressly permitted by these Terms, you may not copy, reproduce, distribute, modify, publish, sell, license, create derivative works from, publicly display, publicly perform, or otherwise exploit MoSciFIT's proprietary content or technology without written permission. MoSciFIT, its names, logos, trademarks, service marks, designs, software, and other branding are the property of MoSciFIT or their respective owners. No license is granted except as expressly stated in these Terms.
MoSciFIT may integrate with or rely upon third party services, including payment processors, hosting providers, analytics providers, artificial intelligence providers, authentication providers, app stores, cloud providers, and other technology providers. Third party services may have their own terms and privacy policies. MoSciFIT is not responsible for the acts, omissions, availability, security, functionality, or policies of third party services except to the extent required by applicable law. Your use of third party services may be subject to their separate terms.
If you download MoSciFIT through Apple App Store, Google Play, or another third party app marketplace, that marketplace may impose additional terms. Your relationship concerning the download and use of the application may also be subject to the applicable marketplace's terms. The applicable marketplace is not responsible for providing maintenance or support for MoSciFIT except as required by applicable law.
Certain features may require a paid subscription. Subscription prices, billing frequency, features, promotional offers, and eligibility may vary. Unless otherwise disclosed at purchase, subscriptions automatically renew at the end of each billing period until cancelled. By purchasing a subscription, you authorize MoSciFIT or its designated payment processor to charge the applicable payment method for recurring subscription charges. You are responsible for maintaining accurate billing information.
You may cancel your subscription through the cancellation mechanism made available to you. Cancellation generally becomes effective at the end of the then current billing period unless otherwise required by law or expressly stated at purchase. Unless required by applicable law or expressly provided by MoSciFIT, subscription fees are non-refundable and unused portions of a billing period are not prorated.
If you delete your MoSciFIT account entirely, any subscription billed directly through MoSciFIT's own payment processor is cancelled immediately as part of that deletion, rather than continuing until the end of the then current billing period. This is different from cancelling only your subscription while keeping your account, which remains in effect until the end of the then current billing period as described above. A subscription purchased through a third party marketplace, such as the Apple App Store or Google Play, must still be cancelled separately through that marketplace, since MoSciFIT cannot cancel it on your behalf.
Deleting your account does not necessarily constitute cancellation of a subscription purchased through a third party marketplace or payment provider. You are responsible for confirming that your subscription has been successfully cancelled.
MoSciFIT may change prices, subscription plans, features, or other Service terms. Where required by applicable law, we will provide notice of material changes before they take effect. If you continue using the Service after a change becomes effective, your continued use constitutes acceptance of the modified terms to the extent permitted by law.
MoSciFIT may offer free trials, discounts, promotional pricing, referral programs, or other promotional offers. Promotional offers may be subject to additional terms. Unless otherwise stated, MoSciFIT may modify, suspend, or terminate promotional offers at any time to the extent permitted by law. If a free trial converts to a paid subscription, you authorize the applicable payment method to be charged according to the disclosed subscription terms.
You may stop using MoSciFIT at any time. MoSciFIT may suspend, restrict, or terminate your access if we reasonably believe that: you violated these Terms; you violated applicable law; your account presents a security risk; your activity may harm another user; you engaged in fraud or abuse; payment obligations were not satisfied; required parental consent cannot be verified; continued access creates legal or regulatory risk; or suspension or termination is otherwise reasonably necessary to protect the Service, users, or MoSciFIT. We may also discontinue the Service or any portion of it. Where appropriate and legally required, we may provide notice before termination.
Upon termination, your right to access and use the Service ends. Provisions that by their nature should survive termination will survive, including provisions concerning: intellectual property; User Content; disclaimers; assumption of risk; releases; indemnification; limitations of liability; dispute resolution; arbitration; class action waiver; governing law; and any other provisions that reasonably should survive termination.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
To the maximum extent permitted by applicable law, you and MoSciFIT agree that disputes arising out of or relating to the Service or these Terms will be resolved through individual binding arbitration rather than in court, except where applicable law permits or requires a claim to be brought in court. Before initiating arbitration, the complaining party must provide written notice describing the dispute and requested resolution. The parties will attempt in good faith to resolve the dispute informally for at least thirty (30) days after receipt of the notice. If the dispute cannot be resolved informally, either party may initiate individual arbitration through a mutually agreed arbitration provider or, if the parties cannot agree, an established arbitration provider selected in accordance with applicable law. The arbitrator, rather than a court, will generally determine disputes concerning the interpretation, enforceability, applicability, or formation of these arbitration provisions, except where applicable law provides otherwise. The arbitration will be conducted on an individual basis.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND MOSCIFIT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLASS MEMBER, REPRESENTATIVE, OR PARTICIPANT IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. UNLESS PROHIBITED BY APPLICABLE LAW, THE ARBITRATOR MAY NOT COMBINE OR CONSOLIDATE CLAIMS OF MULTIPLE PEOPLE OR PRESIDE OVER ANY FORM OF REPRESENTATIVE OR CLASS PROCEEDING.
If any portion of this waiver is found unenforceable, the remaining provisions will remain effective to the maximum extent permitted by law.
Nothing in these Terms prevents either party from: bringing an individual claim in small claims court if legally available; seeking temporary or preliminary injunctive relief where necessary to protect intellectual property or confidential rights; reporting conduct to a government agency; exercising rights that cannot legally be waived; or bringing a claim that applicable law requires to be heard in court.
To the maximum extent permitted by applicable law, these Terms and disputes arising from or relating to the Service will be governed by the laws of the State of Michigan, without regard to conflict-of-law principles. Any court proceeding permitted under these Terms will be brought in a court of competent jurisdiction located in Michigan, unless applicable law requires otherwise.
To the maximum extent permitted by applicable law, any claim arising out of or relating to the Service or these Terms must be brought within one (1) year after the event giving rise to the claim occurred. If applicable law prohibits this contractual limitation period, the applicable statutory period will apply instead.
You agree that clicking an acceptance button, checking a box, creating an account, purchasing a subscription, or otherwise using the Service may constitute an electronic signature and acceptance of these Terms to the extent permitted by applicable law. Electronic records of your acceptance may be retained as evidence of your agreement. You agree that we may provide notices electronically through the Service, by email, or through other reasonable electronic means.
We may modify these Terms from time to time. When we make material changes, we may provide notice through the Service, by email, or through another reasonable method. The updated Terms will become effective on the date stated in the updated Terms. We do not guarantee uninterrupted or error free operation. We may temporarily suspend access for maintenance, security, upgrades, or other operational reasons.
Your use of MoSciFIT does not establish a professional relationship between you and MoSciFIT or between you and any person associated with MoSciFIT unless expressly stated otherwise in a separate written agreement. Any information provided by MoSciFIT personnel, contractors, community members, AI systems, or other sources through the Service should not be interpreted as individualized professional healthcare advice unless expressly provided by a separately qualified professional under an applicable professional relationship.
MoSciFIT will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, severe weather, war, terrorism, civil unrest, labor disputes, government action, internet outages, telecommunications failures, power failures, cyber incidents, infrastructure failures, or failures of third party service providers.
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be modified or limited to the minimum extent necessary to make it enforceable where legally permitted. If modification is not possible, the provision will be severed and the remaining provisions will continue in full force and effect.
Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision later. A waiver must be provided in writing by an authorized representative of MoSciFIT.
These Terms, together with the Privacy Policy and any additional terms expressly incorporated into these Terms, constitute the entire agreement between you and MoSciFIT concerning your use of the Service, except where a separate written agreement applies. They supersede prior agreements, representations, or understandings concerning the same subject matter.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. MoSciFIT may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, corporate reorganization, sale of assets, financing, or other business transaction, subject to applicable law.
Except as expressly stated in these Terms, these Terms do not create rights for third parties. MoSciFIT's affiliates, service providers, contractors, licensors, and other protected parties may be intended third party beneficiaries of provisions that expressly protect them.
